CLIENT RESPONSIBILITY:

The client is responsible for any damages caused by negligence while operating the motorcycle during the tour. Participants of the motorcycle tour acknowledge and accept the risks and dangers involved and assume full liability. They are also responsible for any damages caused to third parties and agree to waive all claims against "MOTOMERZOUGA" and its employees for any personal damages that may occur during the tour. Any complaints must be reported immediately to the tour guide and cannot be considered at a later time. We do not accept any liability for delays caused by breakdowns or necessary repairs to motorcycles or transportation vehicles during the tour. In the event of any disputes, they will be settled in a competent court of law in Morocco.


CONDUCT:

MOTO MERZOUGA and its authorized representatives hold the sole discretion to exclude any individual from participating in a trip or tour, in the event that the person's behavior or conduct interferes with the smooth operation of the trip or compromises the welfare, rights or enjoyment of other members of the group. Refunds are generally not issued under these circumstances. In exceptional cases where a refund is granted, the maximum amount that MOTO MERZOUGA will reimburse will be limited to the cost of unused services.


PERSONAL INSURANCE:

It is important to note that there is no local insurance available to cover any injury sustained by the rider, medical bills or repatriation costs arising from an accident. Therefore, it is mandatory for all clients to obtain additional insurance coverage at their own expense in their home country. The insurance coverage should include tour and travel cancellation/interruption, personal accident, health and medical, repatriation, property loss, among other necessary coverage. Clients who fail to provide proof of such insurance at the beginning of the tour may be denied access to MOTO MERZOUGA equipment.


WEATHER CONDITIONS

MOTO MERZOUGA makes every effort to schedule tours during times of the year when the weather in the touring area is typically suitable for motorcycle riding. However, some of our tours pass through regions where weather conditions can change abruptly and significantly. It is important to note that MOTO MERZOUGA cannot be held responsible for any unfavorable weather conditions that may arise during the tour, and no refunds will be issued under such circumstances. We do, however, reserve the right to make necessary route adjustments to enhance the quality of the tour and to ensure the comfort and well-being of our clients.


RIDER REQUIREMENTS:

All riders must be at least 18 years of age and hold an unrestricted motorcycle license for unlimited capacity motorcycles in their country of residence. It is mandatory for all riders to comply with all local traffic rules and regulations. A briefing on local speed limits and other relevant traffic regulations will be provided by the tour leader to each rider. It is the rider's sole responsibility to adhere to all traffic regulations and wear helmets at all times.

Riders must adjust their riding to accommodate changes in weather, road conditions, and other road users. It is important to acknowledge that motorcycling can be a risky activity, and riders are aware of the potential risks involved and fully accept them. Riders are solely responsible for keeping their motorcycle under control, selecting appropriate speeds for the conditions, and adhering to the country's road traffic laws. Even when following a tour guide in convoy formation with other motorcyclists, riders are solely responsible for their choice of riding style and speed selection.

Riders, their heirs, successors, and assignors acknowledge and agree to release, indemnify, and hold MOTO MERZOUGA, its agents, contractors, and employees harmless from any and all liability or claims directly or indirectly related to participation on a tour.


DAMAGE POLICY

As part of the rental fee, MOTO MERZOUGA will provide one motorcycle to each client. If, during the tour, the client's motorcycle is damaged due to an accident or negligent use and cannot be used, the client will be required to return to MOTO MERZOUGA premises in either Marrakech or Ouarzazate via public transportation. MOTO MERZOUGA will not provide a second motorcycle to the client, and the cost of returning by public transportation will be the client's sole responsibility. MOTO MERZOUGA will not be held liable for any costs incurred in this regard.

The client is solely responsible for all costs incurred due to damage to the motorcycles and riding gear resulting from accidents and/or negligent and careless riding. In the event of such damage, the cost will be assessed, and deducted from the client's deposit. The client acknowledges and agrees to assume all responsibility for any such costs incurred during the tour.


MEDICAL & HEALTH ADVICE

If you have any pre-existing medical conditions, it's important to inform MOTO MERZOUGA before embarking on your tour. This is especially crucial since some parts of the tour will take you to some of the most remote places in Morocco, where evacuation can be difficult, expensive, or even impossible under certain circumstances.

We strongly recommend that clients take special care of themselves and their health during the tour. If you feel unwell or experience any symptoms of illness, it's important to inform us as soon as possible so that we can begin making arrangements for evacuation, if necessary. It's also worth noting that hospital facilities in Morocco are generally of a good standard. By disclosing any pre-existing medical conditions to us beforehand, you can help us ensure your safety and well-being throughout the tour. This will also enable us to take any necessary precautions and make arrangements to ensure that you receive the appropriate medical attention in the event of an emergency.

By participating in our motorcycle tours, clients accept full responsibility for any damage caused by negligence in the operation of the motorcycle and accept full liability for any risks and dangers involved. Moto Merzouga reserves the right to disqualify any person from the tour if their actions or general deportment impede the operation of the trip or the rights, welfare, or enjoyment of other members of the tour. Refunds are not typically given under these circumstances. If a refund is granted in extraordinary instances, the limit of Moto Merzouga's reimbursement will not exceed the cost of unused services. It is obligatory that clients take out additional insurance at their own expense to cover injury to the rider, medical bills, repatriation costs resulting from an accident, tour and travel cancellation/interruption, personal accident, health and medical, repatriation, property loss, etc. Clients may be refused access to Moto Merzouga equipment if evidence of such insurance cover is not shown at the start of the tour.


WHAT IS NEEDED:

An inclusive tour means that everything is included in the tour price. This includes full board and accommodation, bike hire, back-up, and third-party insurance cover. The only additional expenses you would need to pay for upon arrival in Ouarzazate are riding equipment (which is available for rental for 20 euros per day), drinks, and souvenirs that you may want to purchase in one of the local markets.

Accommodation varies greatly, from luxury hotels in the centre of town that are frequented by film crews to small hotels in the Atlas Mountains and auberges at the dunes and some of the oases. Third-party insurance cover is provided, but it is essential that you take out your own travel insurance to cover medical, repatriation, and legal fees. Additionally, you will need a full bike license.
